Die Beklagte hielt dem in der Duplik entgegen, die Klägerin mache lediglich
geltend, die verurkundeten Berichte würden nicht Ziff. 9.6 des "Distribution
Agreement" entsprechen, was bestritten werde. Die Klägerin sage auch
nicht, was gefehlt habe (act. 235, Duplik N. 229 f.).

4.2.5.8.2. Würdigung
Unter Ziff. 9.6 des "Distribution Agreement" (KB 3, S. 8) wurde vereinbart,
dass "[t]he 'distributor' shall provide the 'Company', in writing, a 3-month
rolling forecast of purchases and sales for each of the 'Products' no later
than by the 8th working day of the current quarter for the subsequent rolling
quarter."
