Unbestritten und aus Ziff. 6.7 des "Distribution Agreement" (KB 3, S. 6) ersichtlich ist, dass dieses Umsatzvorgaben vorsah, indem festgehalten
wurde, dass "[t]he annual sales volumes have been agreed to by the 'Parties' and attached hereto and marked as Annex No. 2. The 'Parties' have
agreed that a tolerance level of 10 % shall be allowed against these set
annual volumes." Unter Ziff. 1 des Annex 2 findet sich eine Tabelle mit
"I._____". Damit ist erwiesen, dass unter dem "Distribution Agreement"
Umsatzvorgaben zu erfüllen waren.
